Terms of Service

These Terms of Service ("Terms") govern your access to and use of capmon.fun, play.capmon.fun, and related pages, applications, and services (together, the "Services"), operated by Capmon World ("Capmon World," "we," "us," or "our"), a business registered in British Columbia, Canada (Registration No. FM1104629, Business Number 721025237BC0001).

Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years of age to access or use the Services. By using the Services, you represent and warrant that you are at least 18 years old and that your use complies with all laws applicable to you. The Services are not available where prohibited by law. It is your responsibility to ensure that your use of the Services, including any interaction with blockchain technology, is lawful in your jurisdiction.

2. Description of the Services

Capmon World is a video game and related technology project. The Services currently include an early playable game (the "MVP"), a demonstration application on the Solana devnet test network at play.capmon.fun, a free Founder Supporter List, and the Community Signal leaderboard. The Services are under active development and are offered on an "as is" and "as available" basis.

3. Development and Beta Status

The Services are a work in progress. Features, mechanics, designs, timelines, roadmaps, and other elements are subject to change, delay, or cancellation at any time without notice. We make no guarantee that any feature, milestone, or future version (including a mainnet launch) will be released, will function as described, or will be available indefinitely. Any roadmap or timeline we publish reflects current intentions only and is not a commitment.

4. The Founder Supporter Program

The Founder Supporter List is a free interest list. Joining requires only an email address and an X handle, and optionally a Discord username. No purchase, payment, token sale, or financial transaction is required or available through the Founder Supporter Program or on the pages describing it. Joining the Supporter List does not create any ownership interest, security, share, or financial right of any kind. It signs you up to receive updates and, when available, Beta Access and the opportunity to claim certain in-game items as described on the Services. We may modify or discontinue the Founder Supporter Program at any time.

5. Digital Collectibles and In-Game Items (Not Investments)

The Services may allow you to obtain, hold, or use digital collectibles, non-fungible tokens (NFTs), characters ("Capmon"), autonomous agents ("Capbots"), and other in-game items. You acknowledge and agree that:

• These items are intended solely for use and enjoyment within the game as in-game items and digital collectibles;
• They are not offered or sold as investments, securities, shares, or financial instruments of any kind;
• We make no representation or promise that any item has, will retain, or will increase in monetary value;
• You should not acquire or use any item with the expectation of profit or financial return;
• Any value, utility, scarcity, or characteristic of an item is for gameplay and entertainment purposes.

You are solely responsible for any decisions you make in connection with digital collectibles and for understanding the risks of blockchain technology.

6. Cap Coins (In-Game Currency)

"Cap Coins" are an in-game currency used within the game for in-game purposes, such as obtaining in-game items. Cap Coins are not legal tender, are not redeemable for cash, and carry no monetary value outside the game. We make no guarantee regarding the availability, quantity, utility, or continuity of Cap Coins, and we may modify or discontinue them at any time.

7. Test Network (Devnet) Notice

Our dapp at play.capmon.fun currently operates on the Solana devnet, a public test network that uses no real funds. Test (devnet) tokens, collectibles, and transactions have no monetary value. You should never send real funds or real assets in connection with the devnet Services.

8. No Financial, Investment, or Legal Advice

Nothing on the Services constitutes financial, investment, tax, accounting, or legal advice, or a recommendation to buy, hold, or sell any asset. You are solely responsible for your own decisions and should consult qualified professionals as needed.

9. Forward-Looking Statements

The Services may contain forward-looking statements about our plans, roadmap, features, and expectations. These statements involve risks and uncertainties, are based on current intentions and assumptions, and are not guarantees of future outcomes. Actual results may differ materially. We undertake no obligation to update forward-looking statements except as required by law.

10. Community Signal and Social Media Participation

The Community Signal leaderboard ranks participants based on public activity on X, such as sharing genuine posts about Capmon World and tagging our account. Participation is voluntary and free. Leaderboard rank may confer non-financial benefits such as early Beta Access priority and recognition within the founder community. Leaderboard rank does not entitle you to any payment, security, token sale allocation, or financial benefit. We determine rankings in our reasonable discretion and may adjust the methodology, correct errors, or disqualify activity that is fraudulent, automated, abusive, or in violation of X's rules. When posting about Capmon World, you must comply with X's rules and applicable law, including any requirement to disclose a material connection.

11. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Services or related systems;
• Interfere with, disrupt, or overload the Services;
• Use bots, scripts, or automated means to manipulate the leaderboard or game;
• Reverse engineer, copy, or exploit the Services except as permitted by law;
• Upload or transmit malware or harmful code;
• Impersonate any person or misrepresent your affiliation;
• Infringe the intellectual property or other rights of others.

We may suspend or terminate your access for any violation of these Terms.

12. Intellectual Property

The Services and their content, including game art, characters, names, logos, text, software, and other materials, are owned by Capmon World or our licensors and are protected by intellectual property laws, except where we have released specific components under an open-source license. For example, certain code published on our GitHub under the MIT License is governed by that license. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from our content without our permission.

13. User Content

If you submit content to us, for example feedback or messages, you grant us a non-exclusive, worldwide, royalty-free license to use it for the purpose of operating and improving the Services. You are responsible for the content you submit and represent that you have the rights to submit it.

14. Third-Party Services and Links

The Services integrate with and link to third-party services, such as X, GitHub, blockchain networks, and explorers. We are not responsible for third-party services, their content, or their practices. Your use of third-party services is governed by their own terms and policies.

15. Prior Contributions and Refunds

As a goodwill commitment: if you made a financial contribution to Capmon World in connection with any earlier version of our pages, you remain eligible for a full refund of that contribution at any time, with no deadline and no questions asked. To request a refund, email support@capmon.fun with your transaction details and we will process it. Going forward, the Founder Supporter Program is free and collects no payment.

16. Disclaimers of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY FEATURE OR FUTURE RELEASE WILL BE PROVIDED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPMON WORLD AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR DIGITAL ASSETS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

18. Indemnification

You agree to indemnify and hold harmless Capmon World and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Subject to the dispute-resolution section below, you agree to the exclusive jurisdiction of the courts located in British Columbia, Canada for any disputes arising out of or relating to these Terms or the Services.

Before bringing any formal claim, you agree to first contact us at support@capmon.fun to attempt to resolve the matter informally.

21. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective date" above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

22. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and any additional terms we provide, constitute the entire agreement between you and Capmon World regarding the Services and supersede any prior agreements.
